California Court Confirms Supervisors Are Not Individually Liable Under Labor Code Section 1102.5
Labor Code section 1102.5 prohibits employers from retaliating against employees for engaging in certain protected activity under the Labor Code. A California court recently confirmed that the legislation cannot be used to establish individual liability against supervisors who retaliate against their employees in violation of the statute. The court’s ruling is consistent with prior California Supreme Court rulings addressing discrimination and retaliation under the Fair Employment and Housing Act.
